Back Taxes

Back taxes are a big problem for millions of individuals and small business owners. How do taxpayers get into the position of becoming "Non Filers" and what can they do about it?

It is not against the law to owe taxes. It is, however, against the law to willfully decide not to file tax returns in order to avoid or evade taxes.

How "Non Filers" get into the position varies. It is our experience at LK & Associates, after having interviewed thousands of taxpayers, there are two main types of situations that cause people to not file their returns.

Non Filer Main Causes:

  1. Small Business Entrepreneurial Startups: 80 % of all new business will fail in the first five years due to two reasons. The two causes are; lack of adequate capital and poor business planning. (Small Business Administration Statistic) The undercapitalized businessperson many times resorts to not paying their quarterly estimated taxes on their newly established self-employment income. They get into business the first year and earn, lets say, a modest $50,000 after business expenses, and realize at years end that their tax liability is approximately $15,000 of their earnings. Oops. Now what? They either borrow more money or shut down and go back and get a job, or they tell themselves "we'll make it up this next year and file an extension on the current year." They have a healthy fear that if they file their return before they can pay the tax, that the government will shut down their business. Once nobody from the tax service comes knocking at the door the first year, it becomes easier to get lulled into the "I'll do it next time when business gets better" routine. These business usually go on for 3 to five years before the slow wheels of the tax system catch up and begin a very stressful collection process that includes actions like: Levies on bank accounts. The IRS and State also may levy your customer receivables, which is not great way to build customer confidence. Sometimes the spouses' paycheck from their regular job is garnished and that makes for a stressful and tense home life. To make a bad situation worse, add a tax lien against your home and credit report and you may not only have a tax problem but additional marital and health problems to boot. Does this sound familiar? If so we can help. Call us for your free telephone consultation and learn how you may qualify for a fresh start.

  2. Life Events That Cause Tax Problems - Live long enough and something unexpected is bound to happen to you or those close to you. Real life situation change like Marriage, Divorce, Accidents, Injuries, Sudden Illnesses, Death in the Family, Natural Disasters, Loss of Job and Business failures to name a few. All of these naturally occurring "Life Events" cause loss of income and stress. When people have a sudden loss of income and begin to have stress they many times go into a survival mode. After the smoke clears and things get back to a more stable situation people are often left with choices like bankruptcy to start over. Taxes seem to be the last concern of most people in these stressful times. Family, food, clothing, shelter, transportation a job with stable income are the first priorities. Taxes and the collection process that accompanies them often linger on for years. If you or someone you know is going through similar life events now or have in the past, call us we can help with resolving the tax situation so you can get a fresh start.

Bank Levy

Bank levies are issued as a collection tactic or last resort. We generally have 21 days from issue to get this released for you. If you received a threatening notice to levy call us immediately.

Bankruptcy

Income taxes are dischargeable in a bankruptcy if they meet several guidelines. Call us to find out if your taxes meet the guidelines.

Bookkeeping

Were you records lost, missing, or destroyed? We can help. We can file your back tax returns and the IRS will help us with the records we need.

Civil Penalty

Civil penalties stem from unpaid payroll taxes that are now the responsibility of the individual. If you have payroll tax problems or civil penalties, call us for a consultation about your options. We recently settled a case for $95,000 in payroll tax owed, for a $2,500 offer in compromise.

Example of A Painful Experience Avoided through Negotiation Planning

An individual had prepared their own tax defense prior to coming to us at LK & Associates and the IRS denied their Offer To Compromise the several tens of thousands of dollars in taxes they owed because they determined the person had an ability to pay of approximately $16,800. We reviewed the clients financial disclosures and we discovered they had no car payment in the Offer Proposal they had submitted to the IRS. Furthermore they were driving a 20 year old car that was dying. We discovered that they had recently purchased a car and had a payment of approximately $350/month. This new expense enabled them to settle their IRS debt for less $2,000 in a new Offer In Compromise Proposal. A little tax negotiation planning goes a long way.

File All Back Taxes

It's not against the law to owe taxes; we don't have a debtor's prison. It is against the law to willfully not file your taxes. Let us help you get into compliance. There's no need to have any legal action taken against you. The IRS is not in the practice of prosecuting non-filers when they voluntarily come forward to get into compliance. You can take advantage of this approach..

Garnishment

A Tax Levy or Garnishment as it is often referred to from the IRS or State taxing authorities is an aggressive action issued to your bank, you and your spouses' employer and or your clients accounts payable divisions to collect all the monies owed you or held in trust for you and pay over to the Tax Levying Authority, up to the limit of the amount owed on the levy issued. This action can freeze the funds in your bank accounts, remove your wages from your paycheck, and make your clients fork over the proceeds from the billings you have sent them.

Wow! Think about any action or words that could best get your immediate attention and "Levy" is right up there with the words "The tumor is cancerous"!

Levies should and can be avoided at all costs. If you receive a notice of intent to levy or suspect you might have, (some taxpayers don't open IRS or State notices out of fear or disgust or denial) then call our Office to set up a free telephone consultation. The Professionals at LK & Associates can stop the levies and garnishments before they happen and can remove them with proper negotiation and tax compliance after the fact. Call LK & Associates now. You'll be glad you did!

Offers In Compromise

The Offer in Compromise is one of the most exciting programs for tax solution ever offered by the Internal Revenue Service. If you qualify your tax debt can be Settled for Pennies on the Dollar. Your tax liens will be released and all collection action on the old tax debt is stopped.

What's the catch you ask? Well the IRS has millions of unsettled tax accounts totaling billions of dollars owed. The IRS policies and procedures for collection used in the past cost the government millions chasing after taxpayers that would not produce any results. In 1992 the IRS approved and began fully integrating the new Offer in Compromise process that allows a one time forgiveness of tax debt the taxpayer can prove can't be paid in a reasonable time frame.

It makes good financial sense. After all, in the business world when you can't collect on a debt owed to you, it is written off and the business goes on to serve the rest of it's customers that can and do pay their fees.

The IRS rational is that tax collectors that get a fresh financial start will stay in tax compliance, begin to pay all new taxes owed and stay on the tax rolls for the future. This produces far more revenue in future taxes. And just to insure taxpayers won't repeat offend after the compromise is struck, an IRS written agreement to file and pay on time for the next five years is put into force. If after receiving a compromise the taxpayers re-offends by not filing or paying the new taxes in the next 5 consecutive years then the deal is off, the old tax debt becomes owed once again with the resulting penalties and interest and is returned back to the collections division. Boy , that's what you call a great incentive to stay in compliance. Now all you have to do is call and in 15 minutes we can determine if you qualify to compromise your back taxes. So if you're thinking about procrastinating just put it off and call us today instead!. Click here to read more.
